BizCheck — Terms of Service

1. Acceptance of Terms

By creating a BizCheck account, you agree to these Terms of Service. If you do not agree, do not use BizCheck.

2. Description of Service

BizCheck is a software tool that helps trade and service businesses track job-related expenses, labor hours, revenue changes, and estimated profitability. BizCheck is an organizational and tracking tool only — it does not provide accounting, tax, financial, or legal advice, and figures shown in the app (including profit margin calculations) are estimates based on data entered by you and your team, not verified financial statements.

3. Accounts and Responsibilities

You are responsible for the accuracy of information entered into BizCheck by you and anyone using your business's account, and for maintaining the security of your login credentials. You are responsible for your own business, tax, and financial recordkeeping — BizCheck is a supplementary tool, not a replacement for proper accounting practices or a licensed accountant.

4. Subscription and Billing

BizCheck is offered on a monthly subscription basis. New accounts receive a 30-day free trial. After the trial period, continued access requires an active paid subscription. Payments are processed by Stripe, acting as merchant of record; by subscribing you also agree to Stripe's terms governing payment processing. Subscriptions may be cancelled at any time; no refunds are provided for partial billing periods except where required by law.

5. Acceptable Use

You agree not to use BizCheck for any unlawful purpose, to upload content that is illegal, harassing, or infringing on others' rights, or to attempt to interfere with or gain unauthorized access to the service. Content posted to shared features (such as the bulletin board) is visible to other members of your business and may be removed by business administrators or BizCheck at its discretion.

6. User Content

You retain ownership of the business data, photos, and content you upload to BizCheck. By uploading content, you grant BizCheck a license to store, process, and display that content solely as necessary to provide the service to your business.

7. Disclaimer of Warranties

BIZCHECK IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CALCULATIONS, TOTALS, OR REPORTS GENERATED BY THE SERVICE WILL BE ACCURATE OR COMPLETE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BIZCHECK OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL BIZCHECK'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO BIZCHECK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless BizCheck and its operator from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, or your violation of any rights of a third party.

10. Termination

We may suspend or terminate your access to BizCheck at any time for violation of these terms, non-payment, or any other reason at our discretion, with or without notice.

11. Governing Law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

12. Changes to Terms

We may update these terms from time to time. Continued use of BizCheck after changes take effect constitutes acceptance of the revised terms.
